I posted a question about my house being robbed, earlier this week.  I am know going thru the whole Inventory/Insurance Claim process. My question is this:</p>
<p>My Kodak M1033 Digital Camera was taken among MaNy OtHeR ItEmS&#8230;.The documentation/forms I am in the process of trying to complete ask for the Serial Numbers/Model Numbers, However, I don&#8217;t have this number for my camera or laptop battery? I have been able to locate most of the needed information for some things taken, but unfortunately all of the Documentation for the higher priced items, Warranty&#8217;s, and receipts were kept in a small fireproof safe that GUESS WHAT&#8230;was stolen as well! WHEN IT RAINS IT POURS!  As dumb as I beleive  it may sound are all of the serial numbers the same on kodak M1033 series camera&#8217;s? Like I stated I have NEVER EVER had to file a Insurance claim Home or Auto and I am unsure how important this number is to have?  Any help and or advise I greatly thank you for:)</p>

FLORIDA</p>
<p>I had a car accident a week ago. There was no injuries or property damage (my car got out of the road and somehow it ran sideways in the bushes) but my car is probably gonna be totaled. The cops and the ambulance came at the scene. They got me out of the car and I was totally fine. I was asked if I had anything to drink and I said that I had had a couple of drinks. The cops didn&#8217;t do any tests. I was just put in the ambulance. I was fine but shocked. The cops did not followed me to the hospital. I had blood drawn in the ambulance and I was taken to the hospital. No cops were waiting for me outside I just got to my friends house cause they picked me up and I slept there. I have some questions here.</p>
<p>1. Do you think that the hospital is legally allowed to release my personal health information to the cops.<br />
2. Do you think that when the car insurance company calls the hospital to pay my emergency bill will investigate and find out that I have had alchohol in my blood and pay nothing to me or the auto-financing company?<br />
3.Anyway something has to happen it was an accident and what do you think it will.<br />
4. I want to go to the police department and get the report but I am kind of scared to go remind them of it. Can I sent some of my friends&#8230;?</p>

<p><i>Answer by Rob</i><br/>Here&#8217;s your answers in order.</p>
<p>1. The hospital can not release your health info to the police. It&#8217;s called the HIPA ACT.(or Health care Information Protection Act) So you&#8217;re safe on the case of herpes you got last summer and forgot to tell your girlfriend about.<br />
2. Depending on your state laws, you may want to check to see if just your statement alone is enough for your insurance to deny the claim. If it is, when you meet the adjuster, just offer to get your body shop to add a &#8220;little extra&#8221; for his time if he let&#8217;s the claim go through. Now you will need to make sure you have a body shop that will in fact hook you up. And make sure when you say, &#8220;Little Extra&#8221; you make the quotation mark symbol in the air above your head, so if he&#8217;s taping your conversation, you can claim it was just a joke if you ever go to court.<br />
3. what do &#8220;I&#8221; think will happen? Nothing. As a former &#8220;Police Officer&#8221; I&#8217;ll tell you that we got more important things to do than mess with some teenager wrecking his own car.<br />
4. Sending your friends? Not a good idea. Unless you want them to rat you out. Police stations are scary places. You can never trust that your friends won&#8217;t crack if they get taken into a room and hit with the &#8220;good cop/bad cop routine to find out where you are, and why you aren&#8217;t there. Best just move to Canada and forget the whole thing. They can&#8217;t come after you if you move to Canada. Plus Canada law says that each year, on your birthday, you can trade your car in, no matter what shape it is, on a new car and only pay the same rate as before. So you&#8217;re good.</p>

I was involved in a rear-end collision in which a speeding car hit me. I live in Florida which is a partial no-fault state which I think means that everyone has to carry a minimum amount of insurance coverage for themselves and that their insurance is responsible for paying for their own damages, whether or not they were at fault. At least I think, that&#8217;s what I read on several websites, so I don&#8217;t know how reliable it is.<br />
So after the crash, the girl and her mother were asking me about getting my insurance to handle a rental car. I told them that I wasn&#8217;t sure my insurance had to pay for it and they should call their insurance. But later the next day, the girl called me again and told me she had her car towed to a shop covered by my insurance to get it fixed. I filed a claim about the accident which she asked me to access so she could get the information I provided. I gave it to her since I reported that she was at fault, and I received a call from the auto-store owner stating that they had a problem with my statement and that it said the girl was at fault, to which I responded, &#8220;Yea, she was.&#8221; I told the guy that the girl should be talking to her own insurance company to pay off her damages, because mine isn&#8217;t going to unless they find me at fault. The man basically revealed to me that the girl who rear-ended me HAS NO COLLISION INSURANCE.<br />
Does this mean that the girl and her mother were basically trying to get money from me without contacting their insurance company? Also, isn&#8217;t it required in all 50 states to have collision and medical insurance? What would happen to this girl? Can she even claim any money from my insurance company, and are there any consequences for her not having collision insurance?</p>

STATE: WISCONSIN </p>
<p>I pulled out of a gasstation (onto a side road) and I could see that there were no cars on the oncoming traffic lane on the main road, so I stopped at the stopsign, it was actually a 4way intersection with a stoplight, and a lane with a stop sign for right hand turn. (I felt the shift of momentum when i stopped) and turned right a second later. about 50 feet down the road I saw a car whip a u-turn and accelerate excessively, so I thought it was some moron that was late for his date or something. Turned out it was a cop, he flipped his lights on when he caught up to me and pulled me over. When he asked he if I knew why he pulled me over I gave him my honest answer &#8220;No&#8221;; I thought maybe my headlight was out or something. He stated that I didn&#8217;t stop at the stop sign and after I repeated his statement in a form of a question &#8220;I didn&#8217;t stop at a stop sign?&#8221;, he added &#8220;You didn&#8217;t come to a complete stop&#8221;. Gave him my license and registration, figured what the hell, it&#8217;s the first time that&#8217;s ever happened, I&#8217;ll probably get a verbal or a written warning. He gave me an $  88.00 / 3 point ticket&#8230; </p>
<p>Now obviously $  88 dollars is not a big deal, and neither is 3 points, I don&#8217;t get pulled over much, s I probably had 0 points before he pulled me over. But, a ticket will effect my auto insurance quite a bit. I don&#8217;t think it&#8217;s quite fair that cops pull over females for driving recklessly and let them go with a verbal warning, and then pull over a guy when he didn&#8217;t put anyone in any kind of danger and write a citation&#8230; </p>
<p>I plan on fighting the ticket, but I don&#8217;t have much knowledge about the way the process works. So here&#8217;s a few questions that I&#8217;m wondering about:</p>
<p>1)Can I request to see the video tape from the patrol car prior to accepting or rejecting the plea? </p>
<p>2)Obviously if the tape shows me coming to a complete stop, my point will be proven. but what if he does not even have me on video? I&#8217;m innocent until proven guilty, and without a video he would not have any proof that I did not make a complete stop? Could I argue that since the officer was driving the opposite way, paying attention to the road, and his judgement could be flawed on whether or not it was a complete stop?</p>
<p>3) If the tape proves that I really did not come to a complete stop&#8230; I&#8217;ve never blown a stop sign before or &#8220;failed to come to a complete stop&#8221;&#8230; wouldn&#8217;t it make sense to just give a written warning? I mean the officer&#8217;s crazy u-turn was far more dangerous than someone slowing down to 0.5 miles an hour, and turning right&#8230; I have no problem pleading guilty if the tape shows that I didn&#8217;t stop completely. Oh yea, and the next day I was told that the police department received a grant from the government so they have to give out a certain amount of citations in order to keep it&#8230; which would explain why the officer would be so interested in giving me a ticket. </p>
<p>Any information/suggestions would be much appreciated!<br />

<p>I&#8217;m just curious how can and Officer&#8217;s testimony be accepted as evidence? Regardless of his training, his definition of a stop is no different than mine, and it is in his best interest for me to pay that citation. Seems like what I learned about McJustice system in Criminal Justice class is more extreme than I realized. </p>
<p>But regardless I&#8217;m sure he has me on tape. So I just wanted to know if I can demand to see the tape prior to making my decision. Thank you sir!</p>

I tried fighting a ticket a couple years ago, and the officer was acting weird, making it seem like I&#8217;m crazy for requesting to see the tape, and the district attorney immediately suggested that I take the plea because he saw the tape (which I know for a fact he did not watch). I gave up on fighting the ticket because I didn&#8217;t want to miss anymore work to go to court and it seemed like the attorney was assuming guilt 110% so it would be</p>

<p><i>Answer by Robin</i><br/>If you are certain that you came to a complete stop, or at least very, very close, and not just sailing through it I would contact a local &#8216;traffic law center&#8217; type establishment and fight it. They could probably just settle it for you w/o having to go to court which would result in a fine, but keep the points off your record. That&#8217;s what you don&#8217;t want, especially if you&#8217;re under 25 because those points will linger for a long time in regards to elevated insurance rates</p>

This is the text: &#8220;any person who knowingly and with intent to defraud any insurance company or other person files an application for commercial insurance or a statement of claim for any commercial of personal insurance benefits containing any materially false information, or conceals for the purpose of misleading, information concerning any fact material thereto, and any person who, in connection with such application or claim, knowingly makes or knowingly assists, abets, solicits or conspires with another to make a false report of the theft, destruction, damage or conversion of any motor vehicle to a law enforcement agency, the department of motor vehicles or an insurance company, commits a fraudulent insurance act, which is crime, and shall also be subject to civil penalty not to exceed five thousand dollars and the value of the subject motor vehicle or stated claim for each violation.&#8221;<br />
i am thinking that  it&#8217;s talking about people teliing fake information in order to get money from people or insurance company will get fined. but is that all it says or am i wrong? please help, it is urgent for my mom.  please tell me what it means and maybe a translation to chinese? only if you can by yourself.</p>

			<content:encoded><![CDATA[<p><strong><i>Question by CentralSet</i>: Auto accident in a car sales lot. Manager threatened me. What should I do?</strong><br />
I was looking at trade in values for my BMW at the local BMW dealership. I did it, and went to my car to leave. I pulled out of my parking space (backing up to the right). I then shifted to drive and before I could pull forward, one of the salesman was pulling out of the indoor show room with on of the cars. He backed right into me. Note, I was fully pulled out and about to pull forward to leave before he was even in my view. </p>
<p>The man who hit me hopped out of the car, complained a bit, admitted to it being his fault and citing, I didn&#8217;t see you at all, because of the blind spot in that car. He then offered to paint my front bumper where he hit me. He then drove the car that hit me off the lot to someplace that was out of sight. I went to his office to wait and see if he would ever come back, because before I could even say anything he had left the scene. </p>
<p>He gave me, in writing that he would &#8220;paint and touch up the front bumper&#8221;. I told him (the guy who hit me) that there was more than paint damage and the bumper was pushed back. At that point the manager on site came in and said&#8230; you have my word, I will fix your car for free. I told him I need that in writing, and he again said, you have my word.</p>
<p>I said I need you insurance information (knowing at this point he would not give me anything but his &#8220;word&#8221; that he would get my car fixed). He (the manager not the guy who hit me) then started to try and intimidate me with &#8220;this is private property, so the only one at fault is you but I am trying to do you a favor&#8221;. I asked him again for the insurance information, and he said &#8220;I am not turning this over to our insurance, you are the only one at fault&#8221;. &#8220;This is private property&#8221;. </p>
<p>At that point, I was exclusively dealing with the manager. I told him, forget it, i am just going to call the sheriff. </p>
<p>The sheriff came, and I told him, that they wouldn&#8217;t give me any guarantee but their word that they would fix the damage entirely and that he was trying to intimidate me to get me to leave. I also told him he refused to give me his insurance information and that&#8217;s why I called. </p>
<p>The police officer took a report, citing, they offered to fix my car for free. Note that manager even told the officer that and I have that in writing (so in court, I assume the judge will ask &#8220;if he is the only one at fault, why did you offer to fix it&#8221;) </p>
<p>Regardless. While the officer was talking to the man who actually hit me, the manager sneaked around and came up to me and started threatening me. Parts I remember for sure, he said &#8220;I tried to be nice and fix your car, but you went this far, now I can&#8217;t sell this car, I am going to make you pay for it&#8221;. Also saying &#8220;you are at as much fault as we are&#8221; which was a bold face lie. The man who hit me admitted to not seeing me (he probably could have if he looked a little harder). I had no way of avoiding the accident. I asked him to leave me alone. The officer finished filling the report, noting that they said he didn&#8217;t see me. That he did in fact continue to back up into me, and that I said I was stopped about to pull forward where he came from a spot that I couldn&#8217;t see, so quickly that I could not avoid the hit. He also reported that they offered to fix my car (I don&#8217;t think he has why I didn&#8217;t accept what they gave me in writing, and I didn&#8217;t take their &#8220;word&#8221;) for free (the manager told the officer that, in a last ditch attempt to get me to leave without a report). I overheard the manager tell the officer that if a report gets filed and it goes to insurance, that the car that just sold can no longer be sold as new (which it had just been done as (the sales man was pulling out to put gas in it and deliver it). </p>
<p>I refused the offer to &#8220;fix my car&#8221; citing there is more than just cosmetic damage and they refused to give me any guarantee.</p>
<p>After the report was filled, I talked with the officer for a bit. He said he has no way of proving who hit who, because they had at this point, changed their story to he hit our car. (Note that if that was the case, I would have had to drive INTO their car). Why would they offer to fix my car, if I had driven into their car? He also admitted to not stopping and continued to back up.</p>
<p>Regardless, it was clear it was their fault. Only problem is, they had started lying to put some of the blame on me. I told the officer about him threatening me, and he said that I should just go through the insurance and maybe the courts because it looks like it was clearly their fault.</p>
<p>What should I do about the manager threatening me? Should I sue for something other than just the repairs. I had to sit there for at least 2 hours as I waited for the man to return to the scene, then the trails of trying to get a guarantee that they would fix my car, which they refused to do. </p>
